Cop sues after 911 call-- This is simply amazing.
CASSELBERRY - In January, 1-year-old Joey Cosmillo wandered into the backyard and fell into the family pool. When his mother hauled him out, he wasn't breathing. Rescuers were able to bring him back to life, but he suffered severe brain damage and cannot walk, talk or even swallow.

Now, his family faces another burden: One of the rescuers, Casselberry police Sgt. Andrea Eichhorn, is suing, alleging the family left a puddle of water on the floor that afternoon, causing her to slip and fall.

The boy's grandparents, named in the suit, are mystified and angry.

"The loss we've suffered, and she's seeking money?" said Richard Cosmillo, 69, the boy's grandfather. "Of course there's going to be water in the house. He was sopping wet when we brought him in."

Eichhorn, a 12-year department veteran, would not discuss the suit. Her attorney said those benefits, paid by the city's workers' compensation carrier, were not enough. The suit seeks an unspecified amount of money.

Eichhorn, he said, is a victim. Her knee aches, and she will likely develop arthritis.

If the Cosmillos had made their pool baby-proof, police would not have been called to the scene, there would have been no water on the floor, and Eichhorn would not have hurt herself, he said.

"It's a situation where the Cosmillos have caused these problems, brought them on themselves, then tried to play the victim," he said.

5. There's not a case you can dream up that won't be taken by some lawyer somewhere
Most law students go to law school for the same reason others go to business school or med school - to make money. Worst - this case will be all over the right-wing airwaves and cable news as proof that we need tort reform in order to severely limit the right of individuals to take corporations to court.

6. If the pool makers hadn't made a pool
If the pool makers hadn't made a pool then the family wouldn't have brought it and then the child wouldn't have fallen and the police would not have had to be called. And if the cement or plastic makers had not developed the material to build the pool then the manufactures would not have started the business to sell the pools and the family wouldn't have had to buy the pool and then the police wouldn't have had to go to the house.

This could go on for ever. (god should be sued since he made the water that filled the pool that then got onto the floor)

After a fall at work and a broken wrist repaired with pins, I was told that arthritis would eventually develop from the injury.

It is unfortunate that the Sgt. slipped and fell during the rescue. It is even more unfortunate that she, apparently, is so wrapped up in her own bullshit that she fails to comprehend what this family has already gone through.

12. Is the officer suing with regard to the occupants insurance?
If the occupants have insurance then the suit may be set off against the insurance company. If they have no insurance then the plaintiff probably hasn't got much of a chance of getting damages. It's not a nice look but it might just be a procedural thing.

16. I wouldn't be surprised if it were an insurance thing
I had a friend who, some years ago, slipped and fell on an icy step at friend's house. She shattered her elbow and was out of work for some time. Her health insurance refused to pay anything on the grounds that it was covered by homeowner's insurance. Homeowner's insurance blew her off. She had to sue to get compensated for medical bills and lost wages. She felt terrible about having to sue, but it was that or go bankrupt.

Don't know if this is a situation like this, or if it's just an evil woman with a deranged lawyer, but definitely something is wrong if you need to sue someone to get medical bills covered.

21. It may very well be a situation like the one you describe. It really
sounds ugly, but it may be that the officer can't get her medical bills paid without a lawsuit. If this is not the case, however, I would say that she is in the wrong line of work and probably found her lawyer from a tv ad offering "no-win, no-fee" representation.

25. BINGO...I'll bet you anything this is another case of an insurance company trying to avoid
paying a claim. If they can deflect responsibility to the family's homeowners insurance company, so much the better. It may also be the case that the state's workman's comp (privatized in many cases anymore) is also deficient.

Folks, a lot of what's wrong with this country has to do with insurance corporations.

22. Guess workers' compensation doesn't apply to people going into houses
where they could make more money on a third party claim. SUCKS ASS! They should be precluded and covered just like the rest of us with no other options! INSURANCE COMPANIES OWN MERIKA.
