"IF Water boarding is Torture, then it's illegal because torture is illegal."
Mukasey! He refuses to SAY, FLAT-OUT whether Water boarding is TORTURE!!!! THIS is the man the Democrats are going to confirm for AG of the UNITED STATES OF AMERICA!

He just gave this answer to Sheldon Whitehouse who asked him if Waterboarding is torture and Whitehouse told him he was VERY disappointed in that answer.

UNFREAKIN' BELIEVABLE!

It is also entirely useless. It can be applied to anything at all, and does not actually imply anything whatsoever.

"Sir, do you enjoy the taste of Big Macs?"
"If Big Macs are torture, then they're illegal because torture is illegal."

Ah well. I don't expect him to make a stand on that; current law on that is hazy at best, and depends on the entirely subjective definitions of 'extreme' or 'excessive' pain. If the Democrats wanted to ensure people weren't waterboarded, they could introduce legislation declaring waterboarding to be torture.

where constitutional powers are concerned. But he was befuddled when challenged by Leahy, who knows his bill of rights.

10. Bush has said it clearly and quite accurately: "Torture is defined by US law."
And, unfortunately, not all laws originate in the legislative branch, and the relevant laws are inaccessible to most of the citizens of this country. Various legal opinions can cover Bush's ass COMPLETELY! The many, many classified documents generated by John Yoo when in the Office of Legal Counsel has got this covered, and Bush is bulletproof.

This is one of the many realities of US law and the executive branch that people like John Conyers and Nancy Pelosi understand totally and is exactly why impeachment is off the table.

We're all pissed off about this, but it's just the way it is.
