Looks like they did it again, another * crony confirmed to a life long position on the Court! I could be wrong on it being a lifetime appointment!

Circuit judge vote today

WASHINGTON -- The Senate is scheduled to vote at 10 a.m. today on the nomination of former Mississippi Court of Appeals Judge Leslie Southwick to the U.S. Court of Appeals for the Fifth Circuit.

The high-stakes vote comes after two earlier nominees from Mississippi, former U.S. District Judge Charles Pickering and Jackson attorney and Biloxi native Michael Wallace, ran into stiff opposition from liberal activists for their civil rights records.

Southwick has drawn the same criticism, but was able to win over Democrat Sen. Dianne Feinstein of California, a member of the Senate Judiciary Committee, when the panel approved his nomination in August.

Sen. Thad Cochran, R-Miss., who has taken a lead role in promoting Southwick's nomination, was upbeat about the outlook for securing the 60 votes needed today to defeat a filibuster. The so-called cloture vote would allow the Senate to vote on the nomination. The vote would then follow, with only a majority required for approval. "He's hopeful this is good timing," said Cochran spokesperson Margaret McPhillips.

Sen. Trent Lott, R-Miss., was involved in some last-minute negotiations Tuesday with Sen. Ben Nelson, D-Neb., a Southwick supporter who is trying to broker a deal between Democrats and Republicans. Nelson was trying to persuade Democrats to support the procedural cloture vote in order to let the nomination have an up-or-down vote. In return, Republicans would agree not to block spending bills.

"He's reasonably confident that he can get the 60 votes needed for cloture," said Nelson spokesman David DeMartino. Southwick supporters calculate they need 11 Democrats and 9 Republicans to reach the 60-vote margin.

18. I guess Nelson is still trying to use his status as official Democratic Bush Supporter
as some sort of leverage against us--it's his way of staying relevant in the Senate, because Lord knows I don't really know what he does for the people of Nebraska.

11. All federal judgeships are lifetime appointments, as per the Constitution
The judges, both of the supreme and inferior courts, shall hold their offices during good behaviour.... Article III, Section 1 of the United States Constitution.

Then again, I'm sure there was a nice, moderate, centrist reason for confirming a man to the Federal Appeals Court who approves of the use of the word N****R and says being gay is a lifestyle choice that merits punishment.

But I'm guessing he's a proud son of the Mississippi Higher Education system, and a proud graduate of that Jim (Crow) Dandy institution in OxPatch. He's a little too old for Regent and they have a Lawyerin' Skkkool there at Ol' Miss.

17. Not wrong about life long position

All federal judges hold their judgeship "for good behavior" as per the United States Constitution. The only way they can be forced out is through impeachment. I believe retirement age laws merely declares the actual seat on the bench vacant and does not (can not) strip a judge of his authority; if he wishes to remain a judge, he becomes a "judge emetrius" and continues for as long as he wants.

19. I knew that about
their Senior Judge status and the seat being open when they are moved to that Senior status but I wasn't real sure if that was considered a lifetime appointment. Thank for the info.
