Boy in sex case may have to stay in Mexico

A 13-year-old Nebraska boy who investigators say ran off to Mexico with one of his teachers may not be able to return to his family in the United States.

The eighth-grade boy and the teacher, 25-year-old Kelsey Peterson, were found Friday in the Mexican border city of Mexicali. The teen has been living in the U.S. illegally, says Dawson County Attorney Elizabeth Waterman in Nebraska.

"He's been here most of his life," she says. "He was born in Mexico."

Peterson, a math teacher at Lexington Middle School in Lexington, Neb., is accused of having a sexual relationship with the boy. USA Today does not identify possible victims of sex crimes.

She appeared in federal court in El Centro, Calif., on Monday to face charges of transporting a child across state lines or a foreign border for sexual activity, says Joe Stecher, U.S. attorney for the district of Nebraska.

1. That's ridiculous
I'm for a sane immigration policy, but to punish this boy because he was seduced by his teacher is just outrageous.

3. punishment? i know the boy is 13
but the boy is also free to make his own choices, his choice to go to mexico was his, what happened was his. The fact that he is an illegal immigrant in the media spotlight means that the feds will not do anything illegal like bring him back to the united states.

8. Um, in order to prosecute the case
they'll need the victim. In this case, he'd qualify for a U visa (victims of crime) & possibly a T visa (victims of human trafficking) to get legal status in the country. And of course, INS can give him a visa to be in the US for the purposes of prosecuting the trial. Happens along the border all the time.
