If United States Representative Vito J. Fossella Jr. is convicted on charges of driving while intoxicated,
he would face a mandatory five days in jail, according to law enforcement officials in the Washington suburb where the congressman was arrested on Thursday.
According to court documents in Alexandria, Va., Mr. Fossella, the only Republican member of Congress from New York City, had a blood-alcohol level of 0.17. S. Randolph Sengel, the commonwealth attorney for Alexandria, said that a blood-alcohol level higher than 0.15 would require a mandatory jail time of five days. A level higher than 2.0 would require a mandatory jail sentence of 10 days.
Mr. Sengel declined to comment on any specifics of the case against Mr. Fossella. “I’m not going to comment on the outcome of a case before it comes to court,” he said, but he added that “as a general rule, my orders are not to plea bargain them and you don’t offer lesser charges in these cases.”
Mr. Fossella, 43, lives on Staten Island and represents parts of Brooklyn and Staten Island. He won his seat in a special election in 1997 while he was a member of the New York City Council. Two Democratic candidates are vying for their party’s nomination to challenge Mr. Fossella this year.

No doubt you all know how this fuckhead is. He's as nasty as the dean of New York Assholes, Peter King. Since he had a tough time getting elected last cycle, maybe this time will be the charmed one for us. A Repubican from New York City ............ yeah, I know ...... Brooklyn and Staten Island ............ I should think even they're 'over it' by now.
By the way .... add a beard and doesn't he remind you of Ahmadinejad? I'm just sayin' .........
Yeah ..... I know he's Italian. Still ......
