Geragos files for dismissal of Chris Brown case: LAPD allegedly sold photo of badly beaten Rihanna

EXCLUSIVE: Mark Geragos Files Court Papers – Cops Sold Rihanna Photo



Dramatic new developments in the Chris Brown alleged battery case as Brown's high powered attorney, Mark Geragos formally filed a motion late Wednesday in the Los Angeles Superior Court seeking access to internal LAPD records. Geragos says he believes that the photo of a badly beaten Rihanna was illegally leaked to the media by an LAPD Officer -- is harmful to his client -- and could lead to the case being dismissed. Geragos states in the new motion reviewed exclusively by RadarOnline.com that Rihanna, whose real name is Robyn Fenty, was very concerned about information being leaked to the media.

Prior to the photo being leaked to TMZ the motion states, "Ms. Fenty requested that the police reports related to this incident be kept confidential, and a Request for Confidentiality of Information was completed."

However, that wasn't enough to protect her privacy as an alleged crime victim. Geragos states, "I'm informed and believe that on or about February 19, 2009, a photograph taken by the LAPD depicting physical injuries on Ms. Fenty's person was illegally leaked to the media. Specifically, I am informed and believe that this highly prejudicial photograph was sold by an LAPD officer to the entertainment website, TMZ. The photograph was immediately viewed by hundreds of thousands of viewers and was displayed on every news channel for several weeks. In fact, the photograph still remains on the TMZ website. The purpose of the leak was necessarily for profit and to vilify Mr. Brown and poison the potential jury pool."

...years ago I had an aquarium, and a little catfish that spent most of its time with its lips suction-cupped to the tank, swimming back and forth, just sucking whatever it could off of the glass.

In our judicial system, the guilty and the innocent have the right to a trial. If Geragos has decided that making an ass-load of money from defending the scum of the earth who can afford his services is the way to go, maybe we just need to think of him as our little always-sucking catfish in the tank.

She's thinking in terms of being known as Rihanna the singer versus Rihanna Who Had The Everloving Shit Beat Out Of Her By Chris Brown. She's willing to trade justice for gradually diminishing media coverage of her days as a punching bag.

Meanwhile, Chris and his buddies can high-five each other over his "legal victory."

10. Who knows why she doesn't want it
For example, Santonio Holmes a WR for the Steelers who caught the winning TD was involved in a domestic violence situation. His wife wanted to drop charges but the prosecutor wanted to go foward anyways. So his wife showed up next to Holmes in court and then that is when charges were dropped. There are no photos so I have no way it is true as much as it is in the Chris Brown case. I think sometimes people just want to forgive and forget but I have no idea nor do I claim to know what the victim is thinking.

All because the cops sold a picture that pretty much proves he is a criminal. People should learn to pay cops to do this, then they can do whatever they want and not worry about justice! :sarcasm:

5. Whoever leaked the photo needs to be fired, sued, and prosecuted.
The lovely young man who beat the crap out of Rihanna needs to have the crap beaten out of HIM.

Rihanna needs to get herself an improved spine and become an independent young woman so she doesn't make any more dumb choices in BFs.

19. Wouldn't the photo have to be inadmisable in order for the jury pool to be tainted.
If the judge will allow the DA to use the photo to show extent of the injuries then a juror will not be seeing anything they wouldn't see in court.

Given that I am not sure how his motion has merit.

Now if he motioned to exclude the photo and any other similar photos as prejudicial AND the judge agreed AND THEN he motioned that since any potential juror has seen photo outside the courtroom AND they couldn't find any juror who did (or didn't believe them) THEN I could see a dismissal.

Then again I work in software not law and computers tend to be more logical.
