What part of the 14th Amendment don't you understand? What part of "Equal protection of the laws" is unclear?

4. Ahem...
14th Amendment issues are something that would decided in federal court. The California SC only decides constitutionality as it relates to the state constitution, and has no authority to go beyond that. I don't like the result of Prop. 8 either, but it's the law until such time as voters can be persuaded to repeal it. The judges have to deal with the law as it is, not as they might like it to be.

5. consider this: they said 18k marriages are good. the next marriage
that makes it as a challenge is going to knock prop 8 out because how can 18K marriages be lawful and any following not be.
