A federal judge has ordered one of the Lower Merion School District information-technology specialists in for a deposition.
According to the ruling filed by Judge Jan E. DuBois, Carol Cafiero, one of two Lower Merion school officials responsible for using the technology that allowed the district to remotely activate webcams, should be available for a deposition Friday.
“The court concludes that Cafiero’s deposition is necessary for plaintiffs to ‘investigat
the facts relating to the history and use of the laptop tracking software application and issue in this action,’” the judge’s written order indicated.
The judge’s order was in response to a motion filed by Mark Haltzman, the attorney representing the student who filed the initial suit against the district. In his motion asking the judge to compel the deposition of Cafiero, Haltzman said it was needed “to develop a full factual understanding of the use of the spying software.”

This is getting very complicted very quickly...the Judge has a sterling reputation here...brilliant and incorruptible...has presided over many significant cases in the past. should be very interesting to watch this unfold.
