Glen Beck Smacks Down Cons Like McCain & King Regarding Miranda
“The arrest of a Pakistani-born American in connection with a failed attempt to set off a car bomb in New York City's Times Square has produced a swift and remarkable debate among conservatives over civil rights and national security. Within a matter of hours, Glenn Beck was casting longtime lawmakers as shredders of the Constitution.

The morning after the arrest of 30-year-old Faisal Shahzad at John F. Kennedy airport on Monday evening, the usual suspects in the GOP took to print and the airwaves to whack away at the president and his top lawyer. Rep. Peter King (R-N.Y.) mocked the idea that Attorney General Eric Holder might read the suspect his Miranda rights or consider trying him in a civilian court.”…cont…

“That both McCain and King would so quickly condemn the idea of reading Miranda rights is a reflection of just how far the Republican Party has moved away from a basic element of law enforcement (used often by, among others, the Bush administration's Department of Justice). The suspect, after all, is an American citizen. And in an unexpected moment of dissension, the two lawmakers found themselves on the opposite end of the argument from no less a conservative voice than Beck.

"He is a citizen of the United States, so I say we uphold the laws and the Constitution on citizens," the bombastic Fox News host said to the stunned co-hosts of "Fox and Friends". Normally I'd expect about a quart of tears, about 10 minutes of wailing about his poor childhood and how he's going to burn the Bill of Rights on a bonfire in his backyard just to piss off the environmentalists.

Actually upholding a broad legal opinion based on the citizenship of the accused, is not something that I would normally expect from a skidmark like Beck.

What would you expect from that asshole?

8 posts and a tombstone. My record at freeperland is much better than that. I can usually hold out for 30 or 40 posts before the stupid gets to me.

15. The correct answer is...
Citizen or not the Constitution entitles every person in the country to due process which includes the right to an attorney, the right to remain silent, the right to a speedy trial, etc...

Beck is on the correct side of this issue, though he needed to extend constitutional protections to anyone suspected of criminal activity whether citizen, resident, or other.

He is still and idiot! Just less so than other right wingers on this issue.

14. Miranda rights are read to EVERYBODY arrested in the United States
The Constitution is not a privilege that extends only to citizens. This is the wedge that Beck's playing here. The Constitution refers to anybody detained under force of law by the US government or any state government. They do not - and CANNOT - check citizenship status before they Mirandize you. This is piffle from Beck and his idiot Republican lawmakers.

Sen. Joseph Lieberman (I-Conn.), appearing on Fox News, suggested changing the law to strip the citizenship -- and in turn the rights afforded by the Constitution -- from any American who becomes involved with terrorism.

I think it's time for us to look at whether we want to amend that law to apply it to American citizens who choose to become affiliated with foreign terrorist organizations, whether they should not also be deprived automatically of their citizenship, and therefore be deprived of rights that come with that citizenship when they are apprehended and charged with a terrorist act.
