NARAL statement on Kagan nomination

Statement of Nancy Keenan, President of NARAL Pro-Choice America, on the Nomination of Solicitor General Elena Kagan to the U.S. Supreme Court

Washington, D.C. – Nancy Keenan, president of NARAL Pro-Choice America, issued the following statement on President Obama's selection of Solicitor General Elena Kagan to succeed retiring Justice John Paul Stevens on the U.S. Supreme Court.

"President Obama has selected a nominee with a sound record of legal accomplishment. We call on the Senate to give Solicitor General Kagan a fair hearing and look forward to learning more about her views on the right to privacy and the landmark Roe v. Wade decision. President Obama recently reiterated his strong support for constitutional principles that protect women's rights. We will work to ensure Americans receive clear answers to questions regarding these principles as this nomination process moves forward."

"Given the current composition of the court, we will assess Solicitor General Kagan's complete record on privacy and other relevant issues in the same way we did during Justice Sonia Sotomayor's confirmation process. Unlike Chief Justice Roberts or Justice Alito, each of whom had anti-choice records before coming to the Supreme Court, Justice Sotomayor articulated several times throughout her hearing that the constitutional right to privacy includes the right to choose, and thus we supported her nomination for a seat on the nation's highest court."

6. Not behind her, yet. Looking forward to her confirmation testimony first
More a matter of applying pressure on her, noting her strong credentials in general, but reminding her that NARAL will be watching closely how she answers questions during the confirmation process and what kind of answers from her they would find acceptable.

Like most recent nominees, Kagan has avoided throughtout her career anything related to this or several other hot-button issues which could be used against her. This lets her use the standard dodges by nominees during hearings: speaking in generalities, declining comment on cases that might reach the Supreme Court, or chosing not to speculate on hypothetical cases, ...

Kagan is on record regarding a number of other issues in ways that I find troubling based on my current understanding of them. Most of these are consistent with Obama administration polices and statements, but I doubt these accusations could develop enough to derail her confirmation.

Once I saw her Harvard and U. Chicago background, and that she had clerked for Mikva (also Obama's mentor), I concluded Kagan would be our nominee and probably then confirmed as our next Justice.

3. This isn't an endorsement. This is a "wait and see" statement. But since NARAL
DID endorse Joe Lieberman in 2006, their endorsements no longer mean squat to me anyway.

5. He opposed requiring CT hospitals to provide emergency contraception to rape victiims.
I can't find the exact quote of his, but it was to the effect that if a rape victim couldn't get emergency contraception in one CT hospital, no problem-o, she could just go down to the road and try to get it at the next hospital.

8. Yeah, this statement is hardly enthusiastic, complimentary, or reassuring.
It does nothing to pacify my concerns about Kagan's views on privacy or issues of choice. But thankfully, it doesn't do anything to cause me to lose more respect for NARAL.
