Elena Kagan's nomination for a place on the Supreme Court should be welcomed enthusiastically by those who are especially concerned with advancing the cause of racial justice in America. She is knowledgeable about the history of our nation's racial problems and committed to a vision of racial inclusiveness that reflects the best of our national traditions. I say this on the basis of an acquaintanceship with Kagan that dates back almost twenty-five years.

She was in one of the first classes on race relations law that I taught at Harvard Law school. I recall vividly that she was an outstanding student -- so much so that I recommended her with superlatives to my former boss Justice Thurgood Marshall. I thought that she would be an excellent clerk for him partly because she was so able analytically and also because her quiet but passionate commitment to equality before the law would fit in so well with "Mr. Civil Rights." I was delighted when Justice Marshall offered her the clerkship and was unsurprised later when the Justice told me that her work for him had been exemplary.

First, it is mistaken to suggest, as some have, that the Dean of Harvard Law School is responsible for all that happens or does not happen with respect to hiring. The Dean is the single most influential member of the faculty. One does not get hired at the law school without the Dean's blessing. At the same time, the Dean does not have the power on her own to hire someone to the faculty. To be hired, a candidate must receive at least a majority, usually a super-majority, of votes. The Dean can seek to persuade, but the Dean at Harvard Law School cannot force professors to move when it comes to faculty hiring, traditionally the most contentious arena of struggle at a famously contentious institution.

1. But that's suppose to be her strength?
If she can't move a bunch of Harvard law professors to her hiring decisions, how's she suppose to move justices to constitutional decisions.

you'd realize how silly you look making that comment.

Second, Kagan was attentive to issues of race in faculty hiring. I say this on the basis of what I observed as the Chair of the Harvard Law School's Entry Level Appointments Committee, a Committee on which, as Dean, Kagan also sat. I often agreed with her assessments of candidates but sometimes disagreed. Even when I did disagree, however, I found her judgments to be eminently sensible. She evaluated candidates carefully and generously, deploying her tough-minded independence but also paying close attention to the opinions of her colleagues.

18. What does that have to do with bringing people to her side?
One of her strengths is suppose to be to bring people over to her point of view. But the original article makes the point that she couldn't get the independent minded faculty to agree with her hiring preferences. Nothing in what you subsequently posted addresses that conflict.

Are liberals only allowed to hire liberals?

What if conservatives only hired conservatives.

What about clients? Are liberals only allowed to have liberal clients too? Greenwald, who voluntarily defended a racist organization who's leader is a convicted murderer wouldn't pass that purity test.

9. Lots of people are making excuses for Ms. Kagan
I'd still like to hear some questions of her at a confirmation hearing and find out what Kagan herself thinks about her hiring record. A lot of people are also trying to convince me that she's a consensus builder and a persuader, but it doesn't appear that she had much success in working her colleagues on the hiring committee.

Or shouldn't we even wonder, let alone question, her record, a record we might find lacking in a nominee put forward by a Republican office-holder?

10. If you think what Prof. Kennedy has written is an excuse,
then I really, really feel sad for you. You should take the time to actually read his accounting of her actions as Dean. He is a first-hand witness to it.

I was impressed by his mind-reading capabilities, and since you're telling me that they're flawless, I guess there's really no need even to go through the formality of a confimation hearing and all those niggling questions. SEAT KAGAN NOW! Or the terrorists win. Or something.

12. Again, you make prejudgments without seeing the forest for the trees.
No one is saying his observation is flawless or that he "reads minds". But he does put to rest, with first hand observations, that she did not engage in bias practices, as has been suggested by her attackers.

Furthermore, no one is saying to "SEAT KAGAN NOW"... only to dismiss of the baseless accusations that have been laid before the hearings ever begin.

She should get a complete and thorough hearing. I suspect she will pass with flying colors, as she has already been reviewed once for the position of Solicitor General. The Supreme Court is a far step beyond that, and she requires further scrutiny. But what she doesn't deserve are attacks on her character, quotes twisted out of context, or examination of her sexual orientation, some of which has been done by people on the left.
