2. Let The Games Begin...
You gotta know McChinless is gonna try to spin this as some big victory. I'm more interested in who the Democratic candidate is...but he may be one of the few teabaggers to win in November and the GOOP's worst nightmare.

5. As an American with a disablity ...
I am really at a loss for words. Scum comes to mind. It took such a long time to get that law passed. Then they gutted out a lot of its impact with repeated court decisions against some of its provisions, and now we are in a climate that very well could be in favor of repealing it. Even with the law, horror stories abound. In a state where there was a court house with only a staircase, no ramps, no elevator a disabled veteran had to lift himself out of his wheelchair and drag himself up one flight of stairs. The deputy sheriffs carried the chair up, but they would not carry it up with him sitting in it. Later when he sued to make the building more accessible, the court said that it would be too much of a financial burden to make the public buildings more friendly to disabled customers.

6. here's the problem...
the ADA is a great law with golden intentions.

BUT you have some blood sucking lawyer vermin who have gone around with tape measures and blackmailed small business owners because a mirror was 3/16" too low...

So the ramp is a necessity... that's great. But if the angle of the ramp is 1.3% variant from the Code... should the owner be sued?

7. So? The fact that there are douchebag lawyers
doesn't mean the law shouldn't exist.

9. "if the angle of the ramp is 1.3% variant from the Code"
Then whoever installed it is on the hook for bringing it into compliance.

16. That is not quite the way it works ...
I worked for the Feds and did EEO for the agency where I worked. The Feds were not bound by the ADA, they were subject to the Voc Rehab act of 1973, but they voluntarily adopted provisions of the ADA which were not in the Voc Rehab act so I had to study it.

You are giving an extreme example which is not even applicable. Small businesses that had less than a certain number of employees were exempted from making physical modifications that they could not afford. Thus, your offering of the mirror would not have applied. Individual small businesses did not have to provide special parking, or ramps or easy open doors. The building I was referring to was a municipal building owned by a city. It was not a private sector business. I don't think it would have bankrupted the city to provide one elevator or arrange attendants to help people who were wheelchair bound to get up a flight of stairs by prearrangement. My agency provided interpreters for members of the public who were deaf and other considerations when requested. It was the law. Whether people like the laws or not we are all bound by them. If we are going to call ourselves a nation of laws we should act like one.

It is particularly shameful that a combat veteran who was injured fighting for our country of laws was treated so badly. You have no guarantee that you will always be able bodied. An illness, a car wreck or any number of other circumstances could leave you needing special help. If that happened do you think you could be quite so philosophical about your own rights, self respect and sense of well being?

10. Rand Paul wouldn't be able to do a thing about the ADA federally.

17. Thanks, but the Federal Government is not bound by the ADA..
It never was. It was bound by the Voc Rehab act of 1973, and voluntarily complied with sections of the ADA which were not covered by Voc Rehab.

However if you need to deal with a state, county, municipality or private sector business above a certain size it would affect you. If he managed to get the law repealed it would affect all of the states while bypassing any federal attempts to stop him.
