Would you back out of the deal?
How many of you would try to back out of this deal or immediately sell the home? Just stick with it?

Was anyone under obligation to disclose this?

A San Francisco man who paid $621,000 for a condo to share with his 10-year old son is fighting to rescind the deal after learning the other unit in the two-unit building is home to a sadomasochism enthusiast who engages in loud "leather sex."

"If you don't know what that means I have a brochure I can lend you so that you can learn about it," the email stated. "I am currently not working so I don't need to keep a regular schedule as a result week nights can be late for me. At times, it is possible and even likely that the sounds of leather sex will be coming from my bedrooms to your bedrooms without an effective sound barrier. While it is not my issue, you may find you need to explain things to your son as it could be confusing to him since it frequently doesn't sound as pleasurable as it is."

4. Huge loss...
Plus he supposedly sunk his retirement into it so likely he won't sell.

If the ex is vindictive could use it in court to keep the kid away...

2. I'm no lawyer, but I think there should be a requirement to disclose a noisy neighbor.
What kinds of activities are causing the noises are of little consequence if legal and consensual.

5. I had a similar problem with the adjoining apartment. We shared a common
bedroom wall and well, it turns out we BOTH complained about it to the management! :rofl:

They've since moved and I've rearranged. The new neighbors aren't quite so vociferous and keep better hours...

6. Get a small PA, mic the "sounds of leather sex", point the speakers
out the window toward the street, and crank it up to 11.

Sounds of leather sex will be heard for blocks, coming from sado-dude's bedroom to the city of San Francisco without an effective sound barrier. The sounds will be very confusing to neighbors as well as the police.

9. I don't think the standard disclosure forms cover this.
Since the current occupant is unemployed maybe he just let the laws of economics work and hope for a vanilla replacement.
