Unprecedented: Obama admin. claims right to censor ‘unclassified’ materials
In the case of former National Security Agency (NSA) executive Thomas A. Drake -- indicted last April and accused of funneling documents to an unnamed reporter at an unnamed newspaper, for stories that have not been identified -- the president's lawyers have made a unique and potentially unprecedented claim.

With less than a month before Drake's trial begins, the Obama administration has filed a memo with the court claim the Classified Information Procedures Act (CIPA) gives courts the right to censor and withhold material that is "unclassified."

"It is simply incorrect to argue that CIPA is a rigid set of procedures that precludes this Court from simultaneously considering the admissibility of classified information as well as other information, whether protected or unclassified," they wrote (PDF).

The argument effectively hinges on earlier court cases which interpreted CIPA as less of a rulebook for judges and more of an advisory. The president's lawyers took that a bit further, suggesting it actually just "provides the tools" needed for the judiciary to decide what information should be protected from the prying eyes of defense attorneys. They also claim the National Security Agency Act of 1959 (NSAA) allows courts to redact any and all information pertaining to the NSA's activities.

In a document filed the following day (PDF), Drake's representation reacted with horror.

"There is no authority for this unprecedented assertion in the context of a criminal case," they wrote.

"The National Security Agency Act of 1959 is a civil statute that does not address criminal prosecutions or the rights of a criminal defendant. The applicable statute is the Classified Information Procedures Act (CIPA). CIPA is the only statute that confers upon courts the authority to admit substitutions for relevant evidence in criminal cases. CIPA authorizes substitutions only for 'classified information,' not unclassified information."

“It’s no secret that most Americans think the country is on the wrong track,” Obama told the group. “But the reason isn’t just failed policies. It’s a system in Washington that has failed the American people. A system that has not kept the most fundamental trust of American democracy: that our government is of the people, and that it must govern for all the people – not just the interests of the wealthy and well-connected.”

Saying that Washington has failed to address the issues that matter most to Americans, Obama outlined his plans to make government more transparent, including:

Lifting the curtain on connections between lobbyists and Members of Congress by creating a centralized database of lobbying reports, congressional ethics records, and campaign finance filings available on the internet in a searchable, sortable and downloadable format,
Expanding lobbying disclosure rules to include lobbyists seeking government contracts and presidential pardons,
Enforcing congressional lobbying laws and ethics rules through an independent entity,
Creating an “contracts and influence” database which will disclose how much federal contractors spend on lobbying, and ensuring citizens have easy access to contract details and contractor performance.

So is has been "commonly used" in other cases and the missing element here is a "detailed affidavit"?

Seems like an unfolding legal case being used by the media to spark outrage. Aftergood's piece isn't even controversial. It's simply a description of the case and brief.

11. Good to know, but isnt there an even more fundamental thing that makes this a non-issue
Correct me if I am wrong, Prosense, but doesn't the President of the United States have the ultimate decision-making authority as to what is and is not classified information and who has the authority to have access to classified information?

The point being, if those objecting to the items in this article prefer, the President can simply designate the information as "secret" and prevent dissemination that way. Will that make those folks happy? No, but then again I doubt anything will.
