ACLU sues Colorade State Troopers over shooting man who refused to let them into home

Dead.

GRAND JUNCTION, Colo. -- Lawyers for the American Civil Liberties Union of Colorado filed suit Tuesday against three Colorado State Patrol officers and two training supervisors in the shooting death of an unarmed Grand Junction man.

Jason Alan Kemp, 31, was shot at point-blank range and killed last summer when he refused to allow officers to enter his home without a search warrant, according to the ACLU.

Kemp was suspected of having crashed his pickup around the corner from his home, according to the state patrol. He apparently walked home and was there when troopers arrived a short time after the crash.

Witnesses said that troopers pounded and kicked on Kemp's front door at 103 Glade Park Road, Unit B, in the Redlands area. He refused to open it, telling troopers to get a search warrant. One witness said Kemp was shot after troopers fired pepper spray through a small opening in the door.

I can see them taking the cases where they think they'll get the most public attention.

17. There are a lot of cases the ACLU passes on.
Why would it surprise you to find them doing triage and selecting the one which will have the best chance of success? Most lawyers are very calculated that way.

What's the problem here? Isn't our current standard for extra-judicial execution "close enough"? Seems like we should have a whole bunch of folks celebrating this person's death for "resisting arrest" or not submitting to his lawful arresters. Insisting on a search warrant clearly marked Mr. Kemp as outside the law, and a person who harbored and espoused dangerous ideas. We couldn't afford to give him a trial, because certain people might have been very upset by it.

Huh. Nope, the argument continues to sound incredibly stupid no matter who it's advanced for.

15. The only people who ask to see search warrants are obviously guilty and
should therefore be executed without the encumbrance of a trial.
