More legal action against Breitbart, courtesy of Anthony Weiner?

Watch Out Breitbart, Weiner's Getting a Lawyer

We all know about the latest scam to come out of Andrew Breitbart's smear machine. Several Kossacks have done great work debunking the silly plot to make it look as though Rep. Anthony Weiner sent a salacious photo to one of his female twitter followers. Still, the wingnuts are flogging this dead horse as hard as they can, and we all know that it's never enough to expose Breitbart and company as the lying bullies they are. That's why this is such good news.

Weiner is engaging counsel to deal with the matter.

"We've retained counsel to explore the proper next steps and to advise us on what civil or criminal actions should be taken," Weiner spokesman Dave Arnold said in an email to The Daily Caller. "This was a prank. We are loath to treat it as more, but we are relying on professional advice."

Finally, one of Breitbart's victims pushes back immediately. I have a feeling that the thugs over at Big Government are having second thoughts about their "prank". I would love to hear from some lawyers about the potential legal consequences facing them.

Sorry for the short diary, but I thought this news might get lost as a comment on the other diaries on this subject.

1. Not sure why Weiner's spokesman is downgrading this to a "prank".
Given Breitbert's past efforts to use defamation to discredit his enemies, I'd be taking the opposite tack...that this is the Right's SOP to fabricate and smear those that they see as a threat to their agenda. Weiner certainly is not some backbenching Congressman...he's leading the fight on a lot of Democratic initiatives which Breitbart, in his position as a paid hack for those with a vested interest in defeating these initiatives, are being targeted for a takedown. If anything, this would smart politics for AW to turn the tables and take Breitbert down....wouldn't do anything but raise his stock in Democratic politics.

2. Isn't it a felony to hack into a congressman's computer?
Didn't someone go to jail for hacking Sarah Palin?

The Weiner culprit should certainly serve some time.

4. I don't think one has to hack into a person's computer to hack into his
Twitter account, since that is not on one's computer.

3. RW lawmakers should realize that if they allow such "pranks"
to go on without any legal consequences, then anyone who wants to can hack into any lawmaker's account and send out compromising messages to discredit that person.
