Driving at interstate speeds, which means faster than the limit. Dark, empty road.
Suddenly with no warning you see a van blocking 2 lanes. The only thing to do is take it to the shoulder or t-bone the van. The he immediately returned to the traffic lane. As should be done. While not hitting the throttle. Who expects people standing in the interstate?
I used to manage a team that did road closures. So I had to take, I think a 3 day DOT class on various lane closing laws. It been 20 years, but to close a lane on an interstate you have to give a miles worth of warning and again every 1/4 mile. At night you have to have illuminated signage. Even then, working on a road crew is incredibly dangerous. People just dont pay attention. Not even considering the drunks, testers and cell phone users.
Unless this guy was impaired or driving at an extreme speed I doubt he will be charged. Remember, he hit people illegally trying to close an interstate. While we may admire their courage it is incredibly dangerous and may put good people in a bad spot.
If I were still religious I would pray for all involved.
Trump has caused and will cause more acts of racial violence. But accidents still happen.
